With Democrats securing a majority in the Senate, Schumer indicated that the caucus intends to use its new position to influence the composition of the federal judiciary and the executive branch.

During an interview on Nov. 5, 2026, Schumer declared that Democrats would not permit the confirmation of what he described as right-wing nominees to the Supreme Court.

The electoral results from Nov. 3, 2026, have placed Democrats in control of the Senate, with projections suggesting the party will hold at least 54 seats. This shift in legislative power has drawn attention to the potential for vacancies on the Supreme Court, specifically regarding Justices Samuel Alito and Clarence Thomas.

In response to the Democratic leader's comments, White House spokeswoman Lauren Bis criticized the move, stating that the administration views the stance as an attempt to politicize the judiciary. Bis affirmed that President Trump remains committed to protecting the independence of the court and will oppose efforts to alter its structure.
